Andre Clovis secures damages for wrongful arrests

Tuckers’ Andre Clovis – Senior Solicitor within the Civil Liberties Department has successfully secured damages for clients who were wrongfully arrested by the police.

David v MPS

The client (JD) brought a claim for assault, false imprisonment and malicious prosecution. He had been the subject of a stop and search (most of which had been filmed on a mobile phone) and the officer had deployed CS Spray. The officer PC Jackson claimed that he feared for the safety of colleagues whom he believed our client posed a threat to, however those officers did not indicate that they felt threatened and had no idea why the police officer had detained our client. The mobile phone footage undermined the arresting officer’s account as did the evidence of several independent witnesses. The Defendant has agreed to pay damages and costs.

Aliowe v MPS

The client (OA) brought a claim for assault, false imprisonment and malicious prosecution. OA had been stopped late at night whilst working as a delivery driver and thereafter had been assaulted by the officer – PC Gittens; CS Spray was also unnecessarily deployed. OA was later charged, but acquitted at Trial. OA had been the subject of what was later found to be an unlawful stop and search (Professional Standards Department). PC Gittens has since been disciplined accordingly. A subsequent civil claim was compromised with the Defendant agreeing to pay damages and costs. The police however declined to apologise.
