“Dad who stabbed a burglar faced longer prison sentence than the intruder”

Claire Parrott and Jill Eastwood of Tuckers’ Manchester office, have recently been successful in securing that a case be dropped against a home owner who was at risk of prosecution for attacking a burglar at his property.  As the detailed report in the Manchester Evening News makes clear the law is materially different depending on whether a home owner is involved in an altercation with an intruder inside or outside the actual home.

Ultimately, in this case, the Crown Prosecution Service decided not to press ahead with the case, finding that the force used by Tuckers’ client, Lee Fellowes, was lawful and proportionate in the circumstances.
